Evidence Act 162 Section 11- All the facts which are not relevant in any other way, when they are relevant: - All the facts which are not relevant in any other way , are relevant in the following cases: - 1) Is inconsistent ; 2) If all those events are connected with themselves or any other event, making the existence or non-existence of any subject matter or relevant event more possible or impossible. Example: The question is whether 'A' has committed a crime in Rajshahi on a particular day. 'A' was in Khulna on that date , it is a relevant incident. At the time of the crime, A was at such a distance from the scene that it was not entirely impossible for him to commit the crime, but it was largely impossible , this is a relevant event. Discussion: Section 11 of the Evidence Act did not implicate the accused in the incident . These issues help to refute the plaintiff's claim by linking it to any other relevant issue. As the accused was elsewhere at the time of the incident so it is not possible for him to cause the incident. It is pertinent to mention here that it is necessary to prove it without any doubt. Defendant's acquittal can be obtained only if it is strongly proved that he is a witness.
