Section 162 of the Evidence Act: - Purpose , preparation and previous or subsequent conduct . The conduct of any party or its representative in a civil case or criminal proceedings or in the trial or incident of such case and any offense committed against any person which is the subject matter of a criminal case , if its conduct affects or is affected by any judicial or relevant matter , However, it is relevant whether the behavior is before or after the incident. Explanation 1- The word 'behavior' in this section will not be included in the statement unless the statement is not just a statement but an explanation of any other act or work. This interpretation will not affect the relevance of the statement to any other section of this Act. Explanation 2- When the behavior of a person is relevant , it is also relevant if the statement given to him or in his presence and in the hearing affects his behavior. Example: a) - 'A' is being tried for the murder of 'B'. 'B' knew that 'A' had killed 'C' and 'B' had tried to extort money from 'A' for fear of disclosing his knowledge - these are relevant facts. B) - The trial of 'A' is going on on the charge of killing 'B' by applying poison. The type of poison that caused the death of 'B' was collected by Tick before the death of 'B' - this is a relevant incident. This section of the Evidence Act deals with purpose , preparation and conduct. Everyone has a purpose before doing anything. And people do things driven by that purpose. Again, in order to achieve the objective, man takes some preparation which plays a helpful role in making his work a complete success. The emotions and feelings of the human mind are expressed through his behavior while doing any other work. Therefore, the purpose , preparation and behavior of the people are relevant in any case or activity.
