Section 498 of the Penal Code of Foreign Affairs has mentioned the punishment of adultery. The law states that if a person has sexual intercourse with a woman who knows another man's wife or has a similar reason for believing it, without the consent of the husband, and if such sexual intercourse is not a crime of rape , then the person will be liable for adultery . Any term up to seven years can be punished with rigorous or non-rigorous imprisonment or fine or both. In this case, the victim must be the wife of another person. However, the interesting thing is that the law does not provide any punishment for adultery. The woman is guilty of aiding and abetting adultery but will not be punished. His Excellency the Lahore High Court has given an unprecedented decision in this regard , which is included in the Pakistan Legal Decision , 1974. Women cannot be accused. However, in order to punish the man, the plaintiff must prove that the accused knew or had reasonable reason to know that the woman who had sex with him was the wife of another person. It is mentioned that a woman cannot be convicted under this section if she is married in the simple belief that her ex-husband has divorced her. More interestingly , no offense can be brought under this section if the woman with whom the sexual intercourse took place was not married at that time. In order to give punishment under this section, the matter of marriage has to be proved properly. In Islam, the punishment for adultery is death. A notable hadith in this regard is: "Allah's Apostle used to punish married adulterers and adulteresses by stoning them to death and , after him , we would also punish them by throwing stones . I am afraid that with the passage of time , people may forget this and maybe Say: We have not found in the Book of Allah any punishment for stoning , and it would be a mistake to forsake this duty which Allah has ordained . The guilt is acknowledged. " - Sahih Muslim , 17: 4194 The hadith implies that punishing those involved in adultery is a duty for Muslims and there is no forgiveness for it. However, the allegation of adultery must be proved 100 percent before punishment can be meted out.
