I would talk to an arborist...................oak is a real hardy tree, but you don't want the tree to be unsafe.  This could be real dangerous.  If oak does not get the proper water or something gets inside the roots.  You don't want that coming down and hitting your house or some person or your car.  What is the city saying?  If it lifts the sidewalk that can be dangerous, someone could fall or you could get hurt cutting the grass.
