When I don't want to return the deposit to the tenants?

Hello counseling. I rented an apartment with a deposit of CZK 10,000. Suddenly, after the tenants move out, there is no carpet, wardrobes, table and chairs in the apartment, etc ... So I have to buy these things before moving in. We have it written in the contract what was in the apartment. That's why I don't want to bail them back, and they're threatening me. I told them that I would return it to them when they put the apartment back in its original condition, and they had no way to do it because they threw out my furniture that they would buy theirs, but then they decided to move back to Slovakia. So what do I do now?

Answer :

Deal with them only in writing, ask them in writing to restore the apartment and list exactly what things are missing in the apartment, set a deadline for them, for example a week. Let them know that if they do not restore the apartment to its original condition, you will keep the deposit and after buying the missing things, you will charge them an arrears or overpayment. Let them know in a letter that due to the fact that the apartment is not in a condition after which they could be rented to someone else, you will suffer damage to the rent-profit. Let them know that you are ready to enforce this as well. How are they threatening you? If they are threatening violence, feel free to call the police and file a criminal complaint. Blackmail is a crime. If you make a profit from renting, file a tax return.
