Hello, please advise. My employer has had financial problems for a long time, he is going into insolvency, but he has not submitted it yet. However, he has not yet paid us the full December payment, nor will we probably receive any more. We were recommended to submit an immediate termination pursuant to §56 para. b) of the Labor Code and subsequently file an insolvency with the company and apply for wage claims to the Labor Office. However, I would like to check whether I can really resign in this situation (according to the above reasons), so that I can still be entitled to severance pay (3-month) and then to full unemployment benefits.
