A minor (or not yet incapacitated) child cannot "decide which of the parents he wants to be with", the court decides ... And the court decides "in the best interests of the child" (NOZ - Act 89/2012 Coll. - https: // www.zakonyprolidi.cz/cs/2012-89#cast2, §907) - and taking into account the wishes of the child, if this "child is sufficiently intellectually and emotionally advanced".
