Jain sick person has fasted in Ramazan. But he died four days after the start of the following month. Do I have to perform qaya samugulo on his behalf ? If he does not get well and dies in the end , then he does not have to pay the qaya. For Allaah says (interpretation of the meaning) : وَمَن كَانَ مَرِيضًا َۡوۡ عَلَى سَفَرٖ فَعِدَّةٞ مِّنۡ أَيَّامٍ أُخَرَۗ﴾ [Al-Baqarah: 6] [Surah Al-Baqarah , verse: 185] Therefore , it is obligatory on the sick person to make up the missed fasts as soon as he recovers. But if he dies before he is able to fast , then the need for fasting will be abolished. Because he did not get any time so that he could make up the fasts. For example, a man died in Shaban before the arrival of Ramadan. Therefore , it is not necessary for him to fast in Ramazan. But if the illness is such that there is no chance of recovery , he will give food to the poor one by one in return for every day.
